Bid Policy & Terms
1. Bids that do not meet the minimum bid amount will not be considered.
2. Sealed bids only, no open bidding will take place.
3. Item is open for bid for 7 days from the date the 1st. bid is placed / received. When the first bid is placed, the items,
   “Bid Deadline” will change from “OPEN”  to a “Bid Deadline Date”. All bids must be received by midnight of the bid
    deadline for that item. Rick McGuire /Magma Technologies will not be responsible for missed or delayed e-mail bids.
4. All bids are finale. Note: If more than one bid received from the same individual, higher bid will prevail.
5. Party placing the winning bid has (5) Five working days, after being notified that they have the winning bid, to make
    payment and arrange for delivery of item. Failure to honor bid & or make payment within that time period will forfeit
    bidder to any claim to item and winning bid will be given to next highest bidder. See Item #10.
6. Winning bidder is responsible for the cost of shipping,(Unless Otherwise Noted ), of item to delivery destination
and shipping cost is not included in winning bid amount and will be added .  See item #7.
7. Shipping will be, “at cost” of boxing and actual shipping.... No mark-up on shipping
by Rick McGuire/Magma Technologies will be added. Receipts for  packaging material and freight
will be given to winning bidder/buyer of item. Freight cost is dependent on weight, size, method of shipping,
and final destination. Insurance on shipping is optional by winning bidder & can be added... See Item #9
Item will be shipped and a tracking number provided as soon as payment clears for both winning bid and freight.
9.  “BEFORE” signing the delivery receipt form from delivery driver :
Damage in transit is the freight companies responsibility .... It is the receiving parties responsibility to
examine item on delivery for damage...Open the box and examine item if box looks damaged. Make note
of any damage on the shipping receipt ....  If damage is unacceptable .... Do not accept delivery of item and make
notation on shipping form ....  “Freight Damaged Not Acceptable”  Items that are damaged in freight and returned
to Rick McGuire / Magma Technologies without notation on shipping companies receipt will not be excepted and
winning bidder will not hold Rick McGuire/ Magma Technologies responsible or liable.
Do not return freight damaged items to Rick McGuire / Magma Technologies without prior approval.
10. Bogus bidding and/or fraudulent bidding/bidders will be held accountable to the full extent of the law. Any individuals
that attempt to disrupt this site or process will be held liable for damages.
11. Payments can be made by: 1. credit cards listed to left below, 2. personal and/or company checks for the exact
amount of bid plus freight. ( Do not e-mail credit card info or post on any forms in this web site. )
Personal checks and/or company checks will need to clear bank before shipping item. Winning bidders will be contacted
by e-mail, then a phone call will be made to you for payment and shipping arrangements for security reasons.
12. You Must be 18 yrs. or older to bid , this is a legally binding contract to bid.

Privacy Policy
Rick McGuire/ Magma Technologies has the highest regard for your privacy and will not divulge
or share your information with any party. Information is collected only as needed to perform
the bidding process. The winning bidders identity will be held in the strictest confidence, only the
winning bid “dollar amount” will be posted with the item in the “Open For Bids Gallery”, and only after
winning bid payment is made. Bids are sealed, no open bidding will take place, and bidder info is sealed.
The only other information collected is for those that want to be notified via e-mail on the mailing
list for new art pieces listed.

No information, either mailing list or winning bidders identity, will be divulged to any other
party without the consent of the individual except as may be required in a court of law and/or warrant.
The only other occasion will be, with the consent of the winning bidder, to a loosing bidder that
may request to submit an offer to buy from the winning bidder. In such a case that a loosing bidder
desires to make an offer to the winning bidder, the loosing bidder’s offer to buy, will be
forwarded to the winning bidder. Then with the consent of both parties the contact information
that the parties wish to divulge to each other will be passed along. Any transaction between
those two parties will be solely between them and will be a private transaction between them and
not be between Rick McGuire / Magma Technologies nor will either party hold
Rick McGuire / Magma Technologies liable for that transaction or any coincidental damages.
